Section 1557 of the ACA prohibits discrimination under health programs and activities on the basis of sex, race, color, national origin, age or disability. Final regulations interpreted Section 1557 as prohibiting discrimination on the basis of gender identity and termination of pregnancy. On December 31, the U.S. District Court for the Northern District of Texas granted a nationwide injunction against government enforcement of the regulations to the extent that the regulations prohibit discrimination on the basis of gender identity and termination of pregnancy. Note that the injunction temporarily stops the government from enforcing these regulations but does not stop an individual from filing a lawsuit alleging such discrimination. Read commentary here.
